General Data Protection Regulation

The only data concerning you that we keep in our databases are:

  • You are a subscriber:
    • Your e-mail address
    • Your first and last names as well as your address
    • The date of your subscription
    • The history of your generation requests

  • You are a visitor and have asked to be kept informed of the software developments:
    • Your e-mail address

In the first case, it is your e-mail address that will be your identifier to connect.

You can modify all this data in the « My Account » menu of the software.

The genealogy data transmitted during your generation requests is anonymized before transfer. They do not include any name of person or of place.

In all cases, we make every effort to secure your data which is not sold, rented or made available to anyone except the secure payment site during your subscription and this in accordance with the European Payment Services Directive (PSD2).

We will only use your e-mail address to inform you of new features in the software, to notify you of the end of your subscription and, of course, to reply to your messages.

Each information message you receive has a link to unregister from e-mailing. You can register again at any time (see « Contact » menu)

Cookies

A cookie is a small file saved on your computer by your browser.

This site and the software are fully subscription-funded and do not include any third-party cookies.

The site, the one you are currently browsing, uses its own cookies to enable us to compile statistics on its visits.

  • You have given your consent to cookies:
    • The date and time of your consent (which you can waive at any time by clicking here)
    • A guest number
    • A session number (see below)

  • You have not given your consent to cookies:
    • Nothing other than the session number (see below)

In the app, we also use this technique to remember your options and simplify your connections. In addition to the information relating to your session, the only other data that appears there are those accessible in the « Settings » window of the software.

In all cases, you are assigned a session number. This number is only valid until the end of the session (closing the browser).

Session and guest numbers are used for statistical purposes only. They are randomly generated and do not identify you or your computer.

These cookies are secure and do not contain any personal information.

You can delete these cookies at any time (this is a standard feature of all browsers, you can also do this by clicking here). Deleting cookies will delete all your preferences and the settings will return to their default values. You will no longer be recognized when starting a new session and we will again ask you to accept or refuse cookies.

Terms of Sales

The general conditions of sale described below are those valid on 03/02/2023. They are likely to change later.

Description of services provided

The software, object of this contract, consists of

  • a generator to produce three-dimensional structures from parentage data contained in a file in GEDCOM format,
  • a viewer to display these structures on a screen and to observe them from different angles and at different distances as well as to modify them.

The implementation of the software does not require any installation but it does require an internet connection.

The software is run on a computer equipped with a screen, a keyboard, a mouse and an up-to-date web browser allowing javascript execution.

The implementation of the software is made possible through an annual subscription.

Subscription

The subscription is reserved for residents of the metropolitan France and of the other countries of the European Union.

The subscription gives the subscriber only rights of use.

The subscription allows to generate up to twenty three-dimensional structures. The number of accesses to the generator is limited to twenty per period of one year.

The subscription allows unlimited access to the viewer for a period of one year for any structure generated by the generator.

The subscription does not include engraving costs which are invoiced separately.

The subscription period ends one year after the subscription or renewal date.

In the event of subscription renewal, accesses to the generator not consumed during a period are extended over the following period.

In the event of an early renewal of the subscription (all accesses to the generator consumed), the new expiry date is the old date extended by one year (this allows the renewal to be anticipated at any time without penalty).

If the subscription is not renewed, accesses to the generator that were not consumed are lost.

The subscription allows to save and keep the generated three-dimensional structures on any medium without limitation of the number or nature of the media. The backup and the non-alteration of the structures recorded on these media are of the Subscriber's responsibility.

Price

The price for a subscription is 996 including tax per year (price unchanged in force since 01/01/2021).

Payment is made by credit card from this site in one go.

The subscription opens rights for a period of 1 year to:

  • Access to the generator to generate or regenerate trees up to a maximum of 20 requests.
  • Unlimited access to the viewer.

Right of withdrawal

In accordance with Article L-221-28 13 of the French Consumer Code, the Subscriber expressly waives his right of withdrawal.

Limitations of liability

The Software Publisher Company may not be held liable in the event of force majeure or events beyond its control.

Mediation

In the case of a dispute between the Subscriber and the Software Publisher Company and following the failure of a Subscriber’s written claim to the Company or the Company’s failure to respond within one month, the Subscriber, within one year of his claim, may resort to a mediation procedure by accessing the European Online Dispute Resolution Platform at the following address: https://ec.europa.eu/odr.

This procedure is free of charge and the Subscriber may, at his own expense, be assisted by a council. The Subscriber is free to accept or refuse the use of mediation and, if necessary, the solution proposed by the mediator.

Applicable law and jurisdiction

Any dispute relating to the subscription to the software is subject to French law. The competent courts of Paris shall have exclusive jurisdiction.

The services provided by the software are those defined above in the Terms of Sales.

Usage of the site and of the software implies full acceptance of the general conditions of use described below and valid from 01/01/2021. These terms of use are likely to be modified or supplemented at any time, users are therefore invited to consult them on a regular basis.

The site and the software are normally accessible to users at any time. However, interruptions for technical maintenance may occur. The Software Publisher Company will endeavor to minimize the duration of these interventions.

Limitations of Liability

The responsibility of the Software Publisher Company cannot be engaged in the event of force majeure or facts beyond its control.

The Software Publisher Company cannot be held responsible for direct or indirect damage linked to the use of the software or to the consultation of this site. The user agrees to access it using recent hardware, not containing viruses and with a latest generation browser regularly updated and allowing the execution of javascript.

This site and the software are fully funded by subscriptions and do not contain any banners or advertising links. However, the site may offer links to other sites likely to be of interest to the user (e.g. wikipedia). The Software Publisher Company cannot be held responsible for their content or for direct or indirect damage caused by navigation to these other sites.

The Software Publisher Company cannot be held responsible for the alteration, destruction or loss for any reason whatsoever of the three-dimensional structures kept by the Subscriber.

Intellectual property and counterfeits

The Software Publisher Company remains the holder of the intellectual property rights over all the constituents of the software and of this site apart from those which are in the public domain.

The source codes as well as all the other components of the software are deposited with the APP (French Agency for the Protection of Programs) IDDN No.

Any reproduction, representation, modification, publication, adaptation or decompilation of all or part of the constituents of the software, whatever the means or process used, is prohibited.

Any use of any of these elements will be considered as constituting an infringement and prosecuted in accordance with the provisions of Articles L.335-2 and following of the French Intellectual Property Code.
